1. Eligibility:  Participants are not eligible to receive a Reward (defined below) on their own behalf, but will be eligible to receive a Reward from Mission Product Holdings, Inc. (“Mission”) on behalf of a qualifying school that has fully complied with the Compliance Requirements (set forth below) by participating.  You must be a legal resident of the fifty (50) U.S. and DC, eighteen (18) years of age or older, and you must be an administrator, coach or teacher employed by a high school in order to participate on behalf of your school.  Employees, officers and directors of Mission and its parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Rewards and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to participate.
2. How to Receive Mission Products for Your School:  To participate in the Mission – Korey Stringer Institute (“KSI”) Heat Safety Program (the “Program”) and receive EnduraCool™ products (as more fully set forth below, the “Rewards”), visit www.missionathletecare.com/heatsafetypledge (the “Website”) or e-mail marketing@missionathletecare.com during the Program Period (defined below) and provide your school’s contact information, including your name, phone number, e-mail address and position of employment at the school. A verification form will be emailed to you for completion. Complete the form and submit the requested documentation listed on the form to certify that your school has met each of the KSI Six Key Pillars Regarding Exertional Heat Stroke (the "Compliance Requirements")(which are set forth below) and submit the registration form and requested documentation to marketing@missionathletecare.com.
All required fields must be completed in order to receive the Reward for your school.  If you choose not to complete all required fields or your submission and/or your school do not meet the Compliance Requirements and all other eligibility requirements set forth herein, you will not receive the Reward.
3. Compliance Requirements: Each school must meet the following KSI Six Key Pillars Regarding Exertional Heat Stroke (EHS) in order to qualify for a Reward:
• A wet bulb globe thermometer is on site at the school and used to determine activity modifications based on environmental conditions. It is school policy to modify work to rest cycles based on environmental conditions.
• All coaching staff is certified in first aid, cardiopulmonary resuscitation and the use of an automated external defibrillator. Additionally, education is provided related to preventing sudden death in sport.
• An Athletic Trainer is employed at the school and is on-site during practices and events.
• A specific emergency action plan for each athletic facility has been developed where sports games and practices occur.  This plan is reviewed with the healthcare team every year.
• The school has adopted nationwide high school preseason heat acclimatization guidelines set forth by the National Athletic Trainers’ Association.
• Adequate water is available and placed at various stations around the school’s practice fields for all sports and the school employs body cooling strategies during practice (i.e., shade, helmets off, cooling towels on exposed skin, etc.)
4. Program Details: The Program begins at 7:00 AM EST Eastern Standard Time (“EST”) on August 25, 2014 and continues while supplies last (up to One Million Dollars ($1,000,000.00) in Products will be distributed) or until 11:59 PM EST on August 24, 2017 (the “Program Period”).  No purchase is required in order to participate in the Program.
Each qualifying school that meets all Compliance Requirements will receive a Reward, consisting of an EnduraCool™ product package worth One Thousand Dollars ($1,000.00). One Thousand Dollar ($1,000.00) value includes cost of shipping product package to qualifying school. Limit one (1) Reward per school throughout the Program Period.  Rewards and the Program are subject to all applicable federal, state and local laws and regulations and the Program is void in Puerto Rico and where prohibited, taxed or otherwise restricted.  Your school will be responsible for all federal, state and local taxes, as well as any costs and expenses, associated with acceptance and use of the Reward.
5. Additional Terms: Mission is not responsible (1) if any Reward cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather, acts of terrorism or any other causes outside of Mission’s reasonable control; or (2) for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit your ability to submit your school to the Program or receive or redeem a Reward, including any injury or damage to your or any other person’s computer relating to or resulting from participating in the Program or downloading any materials related to the Program.
6. Grant of Rights: Participation in the Program constitutes each participant’s and each school’s permission for Mission to use his/her/its name, address (city and state), likeness, photograph, picture, portrait, voice, performance, biographical information and/or any statements made by each participant and/or school regarding the Program, Mission, the Reward or for any advertising and promotional purposes, in any and all media now known or hereafter developed, worldwide, in perpetuity, without notice or additional compensation, except where prohibited by law.
7. Release: By participating, each participant and his or her school agrees to release, indemnify and hold harmless Mission and its promotion and advertising agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation property damage, personal injury and/or death which may occur in connection with, preparation for, travel to or participation in the Program, or possession, acceptance and/or use or misuse of any Reward or participation in any Program-related activity and for any claims based on publicity rights, defamation, misappropriation, false association, invasion of privacy and/or breach of contract.
8. Governing Law; Jurisdiction: The use of the Website is open exclusively to legal residents of the United States and the District of Columbia.  Access or use by residents of any other country or jurisdiction is prohibited.  The laws of the United States and the state of New York shall govern these terms and conditions.  YOU HEREBY EXPRESSLY CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN THE COURTS LOCATED IN NEW YORK COUNTY, NEW YORK, UNITED STATES FOR ALL MATTERS ARISING IN CONNECTION WITH THESE TERMS AND CONDITIONS, THE PROGRAM OR YOUR ACCESS TO OR USE OF THE WEBSITE.  You agree that any and all disputes, claims or causes of action arising out of or in connection with this Program shall be resolved individually, without resort to any form of class action; any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program, but in no event attorneys’ fees; and under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased.  Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
